1. Introduction

These Terms & Conditions govern the use of the AI Chatbot widget provided by CogniVis, a brand of "StartupFlow Dawid Adach, Michał Szymański s.c." (hereafter referred to as "CogniVis"). By using the AI Chatbot widget, you agree to these terms in full.

2. Information Collection and Usage

2.1 Data Collected: CogniVis collects all information inputted into the chat, including but not limited to text messages, for analytics purposes. Additionally, CogniVis collects information about the IP address of the user, the dates of the chat, and the URL on which the chat was initiated.

2.2 Account Information: If you are logged into any of the following platforms—https://mdbootstrap.com/, https://tw-elements.com/, https://getdataden.com/, or https://cognivis.ai/—CogniVis may collect your registered account ID to potentially link the chat data to your account information.

3. Data Processing and Storage

3.1 Data Retention: The information collected will be retained for as long as necessary to perform analysis, in accordance with the maximal periods allowed by applicable laws.

3.2 Third-Party Processors: Personal information collected by CogniVis is stored in databases hosted by third parties located in France. These third parties do not have access to your personal information for any purpose other than cloud storage and retrieval. Chat inputs may also be processed by LLM providers, such as OpenAI, under their own policies, which do not include using the data to train their models.

4. Liability Disclaimer

4.1 Unpredictability of LLMs: The AI Chatbot is based on a Large Language Model (LLM). Due to the unpredictable nature of LLMs, CogniVis does not take responsibility for any inaccuracies, hallucinations, or mistaken answers generated by the chatbot.

4.2 Non-Legally Binding Responses: The AI Chatbot cannot and does not enter into legally binding contracts or transactions. Any attempt to rely on the chatbot for such purposes should be disregarded.

5. User Consent

By initiating a chat session with the AI Chatbot, you explicitly agree to these Terms & Conditions. This agreement is also visibly stated in the chat layout.

6. User Rights Under GDPR

6.1 Right to Access, Correct, and Delete Data: Users have the right to request access to their personal data, request corrections, and request deletion of their data. To exercise these rights, users may contact CogniVis at privacy@cognivis.ai.

7. Governing Law and Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of Poland. Any disputes arising from or related to the use of the AI Chatbot shall be subject to the exclusive jurisdiction of the courts of Poland.
